What Is Mediation?
Mediation is a voluntary, confidential process in which a neutral third party — the mediator — helps people in conflict communicate more effectively, understand each other’s perspectives, and explore options for resolving their dispute. Unlike a judge or arbitrator, the mediator does not take sides or make decisions. Instead, the mediator guides the conversation, keeps it productive, and supports the parties in reaching a mutually acceptable agreement.
Compared to the traditional legal process, mediation is typically faster, less adversarial, and far more flexible. Court proceedings can be lengthy, expensive, and focused on determining who is legally “right” or “wrong,” with a judge ultimately making the final decision. Mediation, by contrast, empowers the parties to maintain control over the outcome, encourages collaboration rather than confrontation, and often preserves relationships that litigation can strain or damage.
